On Monday the 27th June 2022 former officer PC Youseff Baida-Machour was subject to an Accelerated Misconduct Hearing at the British Transport Police Force Headquarters, Camden London NW1 9LN.
Former PC Baida-Machour had resigned prior to the hearing and did not attend.
The allegations were that on the 17 December 2021 former officer PC Baida-Machour attended a Christmas night out with police colleagues, was off-duty, in a public bar and whilst there, he engaged in inappropriate conduct towards a female police colleague;
As PC Baida-Machour stood near the bar, he touched the female officers hair and placed it over her breasts, as if to cover them up, and in doing so touched her breasts at least twice. This was repeated 40 minutes later and further to this, PC Baida-Machour touched and/or squeezed the female officers breasts with his hand again as she was walking past him.
PC Baida-Machour should have known that his behaviour, was sexual in nature, violated her personal integrity and privacy, made, or risked making, her feel objectified, uncomfortable and/or embarrassed and that he failed to act with maturity, self-control and respect towards the officer.
The Chair found that the allegations of Discreditable Conduct, Equality & Diversity and Authority, Respect & Courtesy were proven and that the acts cumulatively amounted to Gross Misconduct.
The Chair concluded that, had the officer still been a serving officer, he would have been dismissed without notice.
